Title 5 Inspections For Property Owners Who Are Selling

Septic Preservation Services regularly provide Title 5 Septic Inspections to property owners who are selling and need to have their septic system inspected before a property transfer can take place. Today we have Title 5 inspections for customers in Bridgewater, Halifax, Hanover, Scituate, Marshfield and Canton MA. In Massachusetts a septic inspection is required in the following instances:

  • Within 2 years before a sale. If weather conditions prevent inspection at the time of a sale, the inspection must take place within 6 months afterward.
  • When there is a proposed change to the facility which requires a building or occupancy permit.
  • Any change in the footprint of a building, to make sure that new building construction will not take place on top of any system components or on the system’s reserve area.
  • For large systems with a design flow of 10,000 to 15,000 gallons per day or more at full build-out, on the basin schedule shown in 310 CMR 15.301(6), and every five years thereafter.
  • Every 3 years for shared systems.
  • When the property is divided, or ownership of 2 or more properties is combined.
  • When MassDEP or the local Board of Health orders an inspection

What is worth noting is that your inspection, once done, is valid for 2 years so ideally we would recommend that if you are selling a property with a septic system that you have the Title 5 inspection done as soon as possible. This way if it does unearth any problems you can have them fixed when it wont cause problematic delays. When you have a valid septic inspection which your system has passed that is just one more positive for your property for potential buyers. Title 5 Inspections For Private Homes and a Condominium

Septic Preservation Services provide Title 5 Septic Inspections to many customers in Massachusetts and most are either selling a property or buying a property. This is because a Title 5 Septic Inspection has to take place within 2 years before a sale. However there are other times that a Title 5 Septic Inspection is required. We are providing Title 5 Septic Inspections today in Bellingham, Blackstone, Wrentham, Uxbridge, Grafton and Holliston MA for private properties and one condominium. As specified on the Mas Gov website:

“Condominiums with 5 or more units – all systems must be inspected every 3 years.
Condominiums with fewer units must either inspect all systems every 3 years, or the system serving the unit being transferred must be inspected within 2 years prior to transfer.”

Septic System Inspections For Property Transfers And Voluntary Assessments

Septic Preservation Services’ Massachusetts licensed septic inspectors have been carrying out thorough and reliable septic system inspections in this region for over 25 years.  As stated by the Mass Gov Website Title 5 Septic Inspections are required:

  • Within 2 years before a sale. If weather conditions prevent inspection at the time of a sale, the inspection must take place within 6 months afterward.

The majority of our inspections are for a property transfer, often scheduled by the seller but sometimes we provide an inspection for the buyer of a home with a septic system. “A system owner may choose voluntarily to have an assessment of the condition of the system even if there is no requirement for an inspection. Results of these voluntary assessments are solely for the use of the owner, and do not need to be submitted to local Boards of Health or MassDEP.”

Increases In Flow Of Septic System Requires A Septic Inspection

Septic Preservation Services have many years experience working with the septic industry in this region and because of this we are contacted to do septic inspections for property owners who are selling their home or business property with a septic system and therefore require an inspection. Today we have inspections scheduled for customers in Fairhaven, Mattapoisett, Marion and New Bedford for property sales. We also have a septic inspection today for a property in Acushnet MA for another reason. As required by Title 5 in Massachusetts:

“Changes of Use and Increases in Flow

These situations require a system inspection only if the modification requires a building permit or occupancy permit. For example:

  • adding a bedroom to a house
  • adding seats to a restaurant
  • changing the type of business operating at a commercial location.

Check with your Building Department or Board of Health to find out if your modification meets these requirements.

Any change in the footprint of a building also requires an inspection to determine the location of the system, to ensure that construction will not be located on top of any system components or on the reserve area. Septic Preservation ServicesSeptic Preservation Services has Title 5 Septic Inspections scheduled today in Rowley, Boxford, Groveland, Lynnfield, and Middleton, MA.  Since 1995, Title 5 Septic Inspections have been required in Massachusetts.  You need an onsite septic inspection for the following reasons in general:

 

  • When properties are sold, divided or combined.
  • When there is a change in use or an expansion of a facility.
  • When MassDEP or the local Board of Health requires an inspection.
  • Title 5 requires inspections for large systems, shared systems, and condominiums on a periodic basis.
  • Systems located in cities and towns with MassDEP-approved inspection programs are required to comply with local inspection requirements.

 

There are exceptions and nuances to the general requirements listed here. For example, no inspection is required if the owner has signed an enforceable agreement with the Board of Health to upgrade the system, connect to a sanitary sewer, or connect to a shared system within two years.
