A Title 5 Inspection Is Usually Required When A Property With A Septic System Is Sold

Septic Preservation Services know that moving home at any time of the year is a stressful and time consuming business. If you are selling a home in addition to buying a home this just seems to double the workload. Therefore we try to make one small part of your move as painless as possible. If you are selling a home with a septic system in Massachusetts you are likely to need to have a Title 5 Inspection. As stated on the Mass Gov Website:

“In order to ensure that septic systems (conventional septic systems, cesspools, and innovative/alternative systems) are protective of human health and the environment, MassDEP generally requires that systems be inspected when a property is sold.

When is an inspection required?
When a property is sold to new owners, or there otherwise is a transfer of title to new owners, with certain exceptions.
Title 5 does not require a system inspection if the transfer is of residential real property, and is between the following relationships:
(1) between current spouses;
(2) between parents and their children;
(3) between full siblings; and
(4) where the grantor transfers the real property to be held in a revocable or irrevocable trust, where at least one of the designated beneficiaries is of the first degree of relationship to the grantor”.

Septic Inspections Including a Condominium Septic Inspection

Septic Preservation Services conduct many septic inspections throughout the year and the majority are for property owners who are selling their home or commercial property and need to have a septic inspection because they have a septic system and are not on town sewer. However there are other instances when a septic inspection is required. Today we have septic inspections in Sutton, Oxford, Uxbridge, Grafton, Sturbridge, East Brookfield and Bellingham MA including a condominium septic inspection where the property not being sold. As stated on the Official Website of the Executive Office of Energy and Environmental Affairs:

“Units in a Condominium or Cooperative Corporation.  The cooperative corporation or condominium association shall be responsible for the inspection, maintenance, and upgrade of any system or systems serving the units, unless otherwise provided in the governing documents of the condominium association or the cooperative corporation.  For a facility comprised of five or more condominium or cooperative units, each system located on the facility shall be inspected at least once every three years instead of at time of transfer of title and all existing systems shall be inspected by December 1, 1996.”

Our client’s condominium building is larger than 5 units so we are inspecting their system as required by Massachusetts because it will soon be over 3 years since their last septic inspection. Septic Pumping Is Necessary If You Have A Septic Tank

Septic Preservation Services regularly find that homeowners with Septic Systems are mistakenly under the impression that if their septic system is left alone and there are no signs of septic problems within their home that it will continue to work without maintenance and attention. Septic systems will always require septic pumping but the regularity of this is dependant on a variety of factors including the size or your septic tank and the number of people in your household. We recommend that you have your septic tank pumped every 2-5 years so for example a household with teenage children and a smaller septic tank will need to be pumped more often than a home of a retired couple. The Facts About Cesspools

A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids. The use of cesspools may overload the capacity of the soil to remove bacteria, viruses, and phosphorus, and to nitrify ammonia and organic nitrogen compounds.

A conventional septic system has a tank where solids can settle and begin to degrade, a distribution box, and a soil absorption system (SAS) that further treats the effluent by removing some of the bacteria, viruses, phosphorus, and nitrogen.  Conventional septic systems are now more common, but there are many homes and properties that still have cesspools which are not required to be replaced.  However, cesspools that exhibit signs of hydraulic failure, are located extremely close to private or public water supplies, or otherwise fail to protect or pose a threat to public health, safety or the environment will need to be upgraded.

One of our septic repairs today is for a property whose septic system had a conditional pass after its Title 5 Inspection was carried out.  As specified on the Massachusetts Official website of the executive office of energy and environmental affairs:

 

“A system with specific components that need repair or replacement would qualify for a conditional pass. Examples of system components eligible for a conditional pass include a metal or cracked septic tank, a broken or obstructed pipe, or an uneven distribution box.

When the system component has been repaired or replaced, the Board of Health must issue a Certificate of Compliance confirming that the corrective work has been done.”
