A Title 5 Inspection Is Usually Required When A Property With A Septic System Is Sold

Septic Preservation Services know that moving home at any time of the year is a stressful and time consuming business. If you are selling a home in addition to buying a home this just seems to double the workload. Therefore we try to make one small part of your move as painless as possible. If you are selling a home with a septic system in Massachusetts you are likely to need to have a Title 5 Inspection. As stated on the Mass Gov Website:

“In order to ensure that septic systems (conventional septic systems, cesspools, and innovative/alternative systems) are protective of human health and the environment, MassDEP generally requires that systems be inspected when a property is sold.

When is an inspection required?
When a property is sold to new owners, or there otherwise is a transfer of title to new owners, with certain exceptions.
Title 5 does not require a system inspection if the transfer is of residential real property, and is between the following relationships:
(1) between current spouses;
(2) between parents and their children;
(3) between full siblings; and
(4) where the grantor transfers the real property to be held in a revocable or irrevocable trust, where at least one of the designated beneficiaries is of the first degree of relationship to the grantor”.

Septic Preservation Services wants to wish everyone Happy Christmas for Monday! We are all looking forward to celebrating with our friends and family. Of course nobody wants to be concerned about their septic systems over the holidays but it’s a good idea to be conscious of your water usage. When you have a septic system and are not on town sewer it is recommended to spread laundry loads out over a week rather than do multiple loads on one day which can overload your system. In the same vein try to spread out bath and showers, especially if you have a lot of visitors. If your septic system is designed and sized for a small family but it multiplies in size at holidays just try to be aware of your water usage to prevent problems occurring. Title 5 Inspections Conducted For Property Owners Who Are Selling Their Home Or Commercial Property

Septic Preservation Services know that as stated on the Massachusetts Official Website of the Executive office of Energy and Environmental Affairs:

“a system shall be inspected at or within two years prior to the time of transfer of title to the facility served by the system. An inspection conducted up to three years before the time of transfer may be used if the inspection report is accompanied by system pumping records demonstrating that the system has been pumped at least once a year during that time. “

Because of this many of our Title 5 Inspections are for property owners who are selling their home or commercial property and need to have a Title 5 Septic Inspection done. We do also have septic inspections scheduled for people who are buying a property and want to have their own inspection done prior to purchase of the property. Septic Preservation Services Are The Only Statewide Contractor On The OBD Service Contractor List

Septic Preservation Services have overboard discharge (OBD) services scheduled today in Boothbay, Westport Island, Phippsburg, Friendship, Bremen, Bath and West Bath ME. The Maine DEP’s Overboard Discharge Program is responsible for regulating discharges of sanitary and household wastewater generated at residential or commercial locations to streams, rivers, bays, and the ocean. All OBDs must be approved by the DEP through a licensing process. DEP rule requires all mechanical OBD treatment systems to have an operating alarm system; to maintain a current service contract with a licensed service contractor; and to attach a service tag on or near the treatment system that provides the service contractor’s name and the last date of service. All mechanical systems require power, so be sure that power is supplied to the unit and that it is turned on 7 days a week during the season of use. A Septic System Should Be Pumped Every 3-5 years But This Can Vary Dramatically Depending On Various Factors

Septic Preservation Services have found that many homeowners do not consider their septic system’s limitations when they plan a large event at their home. We have one customer who has a small property with a correspondingly small septic system. However they regularly host large gatherings of friends and family which puts a huge strain on their septic system. They have found that it is more cost effective to hire portable toilets for their events than to have their septic system pumped much more regularly due to the excessive use it gets when more people are using the system. There is also an increased risk of failures due to the large increase in usage it gets at these times. If you are planning a large Christmas Party this holiday season at home or have a lot of extra guests staying at your home for an extended period of time consider your septic system. Sometimes it is worth getting portable toilets in for your party but if you do not make sure you know when your system was last pumped and consider having another pump out after the holidays. A Title 5 Inspection Consists Of The Collection And Recording Of Information

Septic Preservation Services have licensed septic inspectors who are available to carry out Title 5 Septic Inspections for property owners who require an inspection. Often we are contacted by property owners who have a septic system and are planning to sell their home and need to have a Title 5 Inspection completed before they can transfer Title. Once a septic inspection has been done it is valid for 2 years so there is no reason not to have it done as soon as you decide to sell your property. This will prevent any hold ups later in your sale and once it is done it is a positive point for your property. Often property owners have never before had an inspection done so this information from the Official Website of the Executive Office of Energy and Environmental Affairs helps explain what to expect:

“An inspection shall consist of the collection and recording of the following information:

(a)   a general description of the system components and layout;
(b)   quantification of the source/type of sanitary sewage. This should include type of use (domestic or commercial/industrial) as well as the design flow and whether or not the facility being served is occupied at the time of the inspection;
(c)   an analysis of the factors set forth in 310 CMR 15.303 (failure criteria) and, if the system has a design flow of 10,000 gpd or greater, 15.304 (threats to public health and environment);
(d)   water use records for the previous two years for facilities served by public water supply, if available from the supplier;
(e)   a description of the septic tank including:
1.   approximate age, size, and condition of the tank;
2.   distance between bottom of grease/scum layer and the bottom of the outlet baffle;
3.   distance between the top of the scum layer and the top of the outlet tee;
4.   thickness of the grease/scum layer;
5.   depth of the sludge layer and distance from sludge to outlet tee;
6.   physical condition of inlet and outlet tees;
7.   any evidence of leakage into or out of tank; and
8.   any evidence of backup of effluent.
9.   a characterization of the distribution box, and of dosing tanks with pumps, if any, including: a.   any evidence of solids carryover; b.   leakage into or out of the distribution box; c.   whether the flow is equally divided; and d.   any evidence of backup.
10.   a description of the condition of the soil absorption system including: a.   any signs of hydraulic failure; b.   condition of surface vegetation; c.   level of ponding within disposal area; d.   encroachments into disposal area; and e.   other sources of hydraulic loading.
11.   the location of private water supply well (if any) in relation to system components; and
12.   a copy of pump-out records on file with the local Approving Authority.”

If Your Property Has A Cesspool Always Use A Company That Has Cesspool Experience In Massachusetts

Septic Preservation Services are doing a cesspool replacement for a customer in Westport MA today. A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids. The use of cesspools may overload the capacity of the soil to remove bacteria, viruses, and phosphorus, and to nitrify ammonia and organic nitrogen compounds. Over time, when the drainage area around the leaching pool becomes saturated, additional pools may have to be dug to handle the volume. Cesspools must be treated to avoid harmful chemicals from forming and also to empty the pool which needs to be done regularly. This makes cesspools have high maintenance costs.

In Massachusetts Title 5 does not require Cesspools to be replaced:

“only those cesspools that exhibit signs of hydraulic failure, are located extremely close to private or public water supplies, or otherwise fail to protect or pose a threat to public health, safety or the environment will need to be upgraded (310 CMR 15.303). Also, cesspools must be upgraded prior to an increase in design flow (e.g., the addition of a bedroom to a home or seats to a restaurant).” The Official Website of the Executive Office of Energy and Environmental Affairs
